These Terms, Conditions, and Participant Disclaimer ("Agreement") apply to all programming offered by Kind Kitchen Group ("Kind Kitchen," "Company," "We," "Us," "Our"), located in Durham, NC. By registering for any Kind Kitchen class, camp, workshop, event, or program — whether paid or free, and whether through Flodesk, our website, or any other registration platform — you ("Participant," "You," "Your") acknowledge that you have read, understood, and agree to be bound by this Agreement in its entirety.

If you are registering a minor (anyone under the age of 18), "You" refers to the parent or legal guardian completing the registration, and you are agreeing to these terms on behalf of both yourself and your child.

IS THIS PROGRAM THE RIGHT FIT?

Kind Kitchen programming offers a rigorous culinary experience — both emotionally and logistically. Participants will stand and actively cook for extended periods. Before registering, please honestly assess whether you or your child meet the following criteria. The ideal participant:

Can follow multi-step instructions in a fast-paced kitchen environment.

Has the physical stamina for active, hands-on cooking sessions that require standing for extended periods.

Is comfortable working with a wide variety of ingredients, including but not limited to gluten, dairy, eggs, shellfish, proteins, oils, and common kitchen staples.

Is ready and motivated to develop substantive culinary skills in a structured, professional-style setting.

We want every participant to fully engage with and benefit from the experience. If you have concerns about whether this program is the right fit for you or your child, please reach out to us at [email protected] before registering.

IMPORTANT FOOD ALLERGY NOTICE

We cannot accommodate food allergies at this time. While we try our best to maintain a no-nut facility, we cannot guarantee a nut-free or allergen-free environment. Our kitchens handle a wide range of ingredients including but not limited to nuts, tree nuts, gluten, wheat, dairy, eggs, soy, shellfish, and fish.

If you or your child has a food allergy, sensitivity, or dietary restriction that could pose a health or safety risk, you should not register for this program.

By registering, you confirm that you understand and accept this limitation, and you assume full responsibility for any allergic reaction or adverse health event that may occur during participation.

ASSUMPTION OF RISK & RELEASE OF LIABILITY

Participation in Kind Kitchen programming involves inherent risks, including but not limited to: exposure to heat, sharp utensils, kitchen equipment, open flames, hot surfaces, food allergens, and other hazards common to a working kitchen environment.

By registering, you voluntarily assume all risks associated with participation. You acknowledge that Kind Kitchen is not responsible for any injury, illness, allergic reaction, burn, cut, or other harm that may result from participation in any program, class, camp, or event.

You further acknowledge that Kind Kitchen is not responsible for cooking outcomes. Results may vary based on individual skill level, attention, and participation. We do not guarantee any specific culinary result or outcome from our programming.

WAIVER & INDEMNIFICATION

To the fullest extent permitted by law, you agree to waive, release, and hold harmless Kind Kitchen Group, its owners, instructors, employees, agents, volunteers, contractors, and affiliates from any and all claims, demands, causes of action, damages, losses, costs, or expenses (including attorney's fees) arising out of or related to your or your child's participation in any Kind Kitchen programming.

You agree to indemnify Kind Kitchen against any claim brought by or on behalf of you, your child, or any third party related to your participation.

REGISTRATION & PAYMENT

By completing registration through Flodesk, our website, or any other platform, you agree to pay any fees stated at the time of registration. You authorize Kind Kitchen to charge your selected payment method for the total amount due.

All prices are subject to change for future programming. Sales tax will be applied as required by law.

Due to the nature of our programming, all sales are final. Refunds will not be issued unless otherwise stated in writing by Kind Kitchen at the time of registration. If a refund policy is specified for a particular program, that policy will govern.

We reserve the right to cancel, reschedule, or modify any program at our discretion. In the event that we cancel a program, registered participants will receive a full refund or credit toward a future program, at our discretion.

CONDUCT & TERMINATION

All participants — adults and minors alike — are expected to behave respectfully toward instructors, staff, fellow participants, and kitchen facilities. Kind Kitchen reserves the right to remove any participant from a program at any time for disruptive, disrespectful, unsafe, or otherwise inappropriate behavior, without refund.

For minor participants, the parent or legal guardian is responsible for ensuring their child understands and follows program rules and instructor directions.

MEDIA RELEASE

By registering, you grant Kind Kitchen a non-revocable, royalty-free license to photograph, video record, and otherwise capture your or your child's image, likeness, and voice during programming. These materials may be used for marketing, social media, promotional materials, and any other reasonable business purpose without further notice or compensation.

If you do not consent to this media release, you must notify us in writing at [email protected] prior to the start of the program.

INTELLECTUAL PROPERTY

All recipes, curriculum materials, handouts, videos, and other content provided during Kind Kitchen programming are the intellectual property of Kind Kitchen Group. You may not reproduce, distribute, republish, or share any materials without prior written consent.

HEALTH & MEDICAL DISCLOSURE

You are responsible for disclosing any relevant medical conditions, physical limitations, or health concerns that may affect your or your child's ability to safely participate in programming. Kind Kitchen is not a medical provider and does not provide medical advice or accommodations.

COMMUNICATIONS

By registering through Flodesk or any other platform, you consent to receive email communications from Kind Kitchen, including but not limited to program details, updates, newsletters, and promotional offers. You may unsubscribe at any time. Your information will be handled in accordance with our Privacy Policy.

MINORS — ADDITIONAL TERMS

For participants under the age of 18, the parent or legal guardian completing registration agrees to the following additional terms:

You are the legal parent or guardian of the minor being registered and have full authority to agree to this Agreement on their behalf.

You have assessed the program description and honestly determined that your child meets the participation criteria outlined in the "Is This Program the Right Fit?" section above.

You accept full responsibility for your child's behavior, health, safety, and participation during the program.

You understand that Kind Kitchen staff are culinary instructors, not childcare providers, medical professionals, or therapists.

You will provide accurate emergency contact information at the time of registration and ensure your child's instructors are informed of any relevant medical or behavioral information.

DISPUTE RESOLUTION

In the event of a dispute, you agree to make a good-faith effort to resolve the matter directly with Kind Kitchen before pursuing any legal action. If resolution cannot be reached, you agree to attempt Alternative Dispute Resolution or Mediation before filing a civil claim.

GOVERNING LAW

This Agreement is governed by the laws of the State of North Carolina. Any disputes shall be subject to the jurisdiction of the courts in Durham County, North Carolina.

SEVERABILITY

If any provision of this Agreement is found to be unlawful or unenforceable, the remaining provisions shall remain in full force and effect.

CONSENT

By completing registration for any Kind Kitchen programming — whether through Flodesk, our website, or any other method — you confirm that you have read, understood, and agree to be bound by this Agreement in its entirety.
